CASH BACK Policy
Your new home CASH BACK does not apply to preexisting homes owned by individuals. This only applies to purchases of new homes, condos, townhouses, or new construction never previously occupied.
You must register with an on-site sales counselor or agent on your first visit to a new home subdivision or development and simply list Exclusive Buyers Realty Inc. as your RealtorŪ. You must mail, e-mail or fax the forms: Information About Brokerage Services and the Representation Notice to Exclusive Buyers Realty Inc.. You may obtain these in Step 4.
The buyer acknowledges that Exclusive Buyers Realty Inc. is acting as a Buyers Broker in the transaction with the signed Representation Notice acting as the written agreement and acknowledgment. All representation will be done by mail, e-mail, fax, or phone
This offer is void if you have previously visited the new home subdivision or development and previously registered with an on-site sales counselor or agent (unless the builder waives their policy). This agreement is void if the purchaser has entered into a Buyer's Agency agreement with another real estate agent and the contract time has not expired or been cancelled with written notice. The written cancellation of an agreement must be provided Exclusive Buyers Realty Inc. along with the Representation Notice.
Your CASH BACK rebate is 2% of the purchase price of the property as determined by the builder and is based upon a minimum 3% commission paid to the selling broker. If a commission is less than 3%, please contact Exclusive Buyers Realty Inc. before contracting with the builder. There may be more depending on extra commission granted to the broker based on an incentive offer by the builder. You must contact Exclusive Buyers Realty Inc. if more incentive is offered to determine the amount of your total rebate.
Upon acceptance of the terms and conditions of this policy, funds for the rebate from TexasNewHomeCashBack.com and Exclusive Buyers Realty Inc. will come from the commission paid by the Builder or Developer (seller) upon funding the transaction. This rebate is contingent upon approval from the lender and seller and is reflected on the HUD 1 settlement statement.
This offer is void where prohibited by law, lender, or seller.
